1. Platform Scope & Acceptance of Terms
These Terms of Service ("Terms") govern access to and use of the StockMed digital platform (https://stockmed.store) and related mobile applications operated by StockMed Technologies Private Limited ("StockMed"). By accessing or registering on StockMed as a retail chemist, wholesale stockist, or consumer, you agree to be bound by these Terms.
2. Pharmaceutical Regulatory Compliance
StockMed operates as a technology facilitator for the licensed pharmaceutical trade in India:
- Mandatory Drug Licenses: Retail chemist accounts must hold valid Form 20 and Form 21 retail drug licenses issued by their respective State Licensing Authority. Wholesaler accounts must hold valid Form 20B and Form 21B wholesale drug licenses.
- Prohibition on Unlicensed Trade: The procurement and distribution of Schedule H, Schedule H1, and Schedule X prescription medicines through StockMed is strictly limited to verified, licensed entities under the Drugs and Cosmetics Act 1940.
- Accurate Batch & Expiry Records: Chemists and distributors are responsible for verifying batch IDs, expiries, MRPs, and invoice totals upon physical stock inwarding and dispatch.
3. B2B Commercial Orders & Settlement
StockMed facilitates real-time communication of shortage notes and inventory fulfillment between retail pharmacies and authorized stockists:
- Order Fulfillment Discretion: Wholesale distributors retain full authority to accept, pack, or mark items as unavailable based on stock reality.
- Invoicing & Taxes: All commercial transactions are invoiced directly by the fulfilling wholesale stockist via statutory GST tax invoices. StockMed does not levy hidden markups on pharmaceutical products.
- Payment & Settlement: Commercial trade credit terms, discounts, and payment settlements remain direct agreements between the retail chemist and their distributor.
4. User Obligations & Security
Users must maintain the confidentiality of their credentials and terminal access:
- Keep your 4-digit quick auth PIN secure at the pharmacy counter.
- Notify StockMed immediately if you suspect unauthorized access to your account.
- Do not attempt to reverse engineer, scrape, or inject malicious payloads into the StockMed platform or API.
5. Dispute Resolution & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any legal dispute or claim arising out of or in connection with the platform shall be subject to the exclusive jurisdiction of the competent courts in Varanasi, Uttar Pradesh, India.
